Any errors in names, dates, and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking. If minors are involved, it is your responsibility to have proper permission for the minor to travel. It is your responsibility to have the proper documentation for the minor to travel as some destinations or suppliers may require official documents proving parental authority, custody, or guardianship. In addition and without limitation, True North Tides is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities or amenities, such as air-conditioning systems in public places, hotels, and motor coaches may not be up to U.S. standards. If due to weather, flight schedules, or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at the owner's risk. The prices of these tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that True North Tides is not liable for any consequential loss or damage.
CHANGES, REFUNDS AND CANCELLATIONS: Change Fees: Once a travel booking has been confirmed and deposit(s) and/or full payment received, True North Tides reserves the right to charge a $50 non-refundable change fee ("Change Fee") for date changes made at your request for each adult travel booking changed. This Change Fee is in addition to any change fees charged by the travel service provider(s). The amount of the change fee will vary depending on the type of change requested, the supplier(s) involved, and the time period before departure. Please note that some changes may not be possible or may require the purchase of a new ticket. It is important to contact us as soon as possible to discuss your options and avoid any unnecessary fees.
Cancellation and Refunds: Please be aware that many travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for the amount of that fee or charge. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Pricing and availability may change without notice. Passenger(s) agrees that True North Tides is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is True North Tides responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold True North Tides harmless for any actions or damages arising from Supplier pricing. In the case of an airline e-ticket being issued, it is your responsibility to understand your e-ticket’s expiration policy which is unique to the individual airline.
INTERNATIONAL FLIGHTS: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transport disinfection website. (www.transportation.gov/airconsumer/spray).
REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. True North Tides assumes no liability for the acts of the service provider in refusing service.
AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN : Your airline ticket is a contract between you and the air carrier, even if you purchase through True North Tides. If you purchase air travel through True North Tides, you acknowledge and agree that True North Tides does not have the right to control the operations of independent airlines, and agree that True North Tides is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.
You understand and agree that True North Tides functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because True North Tides does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from True North Tides.
True North Tides shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
Frequent Flyer mileage accrual is at the discretion of the airline(s). True North Tides has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.
Seat assignments are not guaranteed even after they are assigned, and True North Tides has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.
HAZARDOUS MATERIALS ADVISORY: It is your responsibility to become familiar with the Hazardous Materials Advisory, and to comply with these advisories. You can find more information at faa.gov: What are Dangerous Goods? | Federal Aviation Administration (faa.gov)
FLIGHT CONFIRMATION: We strongly suggest that clients reconfirm exact flight times with the carrier prior to departure. Air travelers are required to check in at least 2 hours prior to departure time for domestic flights and 3 hours for international flights and must report to the gate at least 30 minutes prior to departure time. Failure to comply may result in the loss of the seat to another passenger.
LIABILITY: True North Tides is not responsible for missed connections, schedule changes, aircraft changes, or trip interruption. It is the traveler’s responsibility to have proper travel documents for all trips including but not limited to vouchers, passports, visas, marriage licenses, or birth certificates. Travel insurance should be purchased to protect you in these circumstances. Change and cancel fees may apply. Hotel and tour operator fees may apply at the time of a change or cancellation of an existing schedule.
LIMITATION OF LIABILITY: To the fullest extent permitted by applicable law, the maximum liability of True North Tides, its owners, agents, independent contractors, successors, predecessors, affiliated entities, and any former business entities, including Moonlit Journeys and Adventure Seekers Travel, arising from or relating to any booking, travel arrangement, or dispute shall be limited to the total commission actually earned by True North Tides in connection with the travel services giving rise to the claim. This limitation applies regardless of the legal theory asserted, whether in contract, tort, negligence, or otherwise.
PLEASE NOTE: all rates are subject to change without notice until deposit is made.
RISKS/SAFETY: Travel to certain destinations may involve greater risk than others. True North Tides urges customers to remain informed as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov
By offering for sale travel to particular destinations, True North Tides does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. Customer participation constitutes acceptance of such events at customer’s own risk.
INDIVIDUAL ENTRY AND EXIT REQUIREMENTS: Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (See: travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html) True North Tides feels it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. (See:www.cic.gc.ca/english/information/faq/inadmissibility/index.asp). It is your responsibility to understand and comply with the vaccinations and health screenings required for your destination.
SUPPLIER INFORMATION: While True North Tides prides itself on selecting top quality Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under our control. Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree True North Tides is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.
We will inform you as soon as reasonably possible if a Supplier needs to make a significant change to your confirmed booking or to cancel. We will also liaise between you and the Supplier in relation to any alternative arrangements offered by the Supplier, but we will have no further liability to you. If the Supplier is unable to offer agreeable alternative services, we will work to obtain and secure an alternate supplier for your travel. We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency or inability to perform. When agreeing to True North Tides' terms and conditions, you are also agreeing to the terms and conditions of the Supplier.
TRAVEL INSURANCE: Travel protection is a common add-on you see when booking flights, cruises, tours, packages, etc. Coverage is limited and may cover trip cancellation or interruption, travel delays, etc. Even when travel protection is included in the booking, additional travel insurance protection is strongly recommended to cover more areas of your trip. As your travel agent, we have a professional responsibility to recommend the purchase of travel insurance to cover certain risks inherent in travel to protect against THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. By declining appropriate travel insurance, passenger(s) acknowledges and accepts liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.
When purchasing travel insurance, we urge you to thoroughly read your policy’s confirmation of benefits. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim. Please note that the travel insurance provider may not be allowed to discuss your claim with True North Tides due to privacy laws (e.g. HIPAA). Passenger(s) acknowledge and agree that True North Tides has no control over the travel insurance provider or its coverage decisions, and as a result, True North Tides is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
Travel insurance is always strongly recommended, and you can browse/purchase policies here: https://17413.buy.tinleg.com/. Cancel for any reason coverage can be added up to 14 days after the first date of booking. Please keep in mind this Tin Leg insurance link is an affiliate link that True North Tides is offering, but is not held responsible for anything related to this or any other supplier. Remember that travel insurance is recommended even when travel protection is already included on your trip as the coverage of each varies.
